Who is responsible for your information

Michael McGarry Art is operated by Michael McGarry. For the purposes of UK data protection law, Michael McGarry is the data controller for personal information collected through this website.

If you have a question about this notice or how your information is used, contact:

Email: michael@michaelmcgarryart.com
Website: www.michaelmcgarryart.com

Information I collect

I may collect:

• your name, if you choose to provide it;
• your email address;
• the type and contents of an enquiry you submit;
• your communication and correspondence with me;
• your Early Access subscription preference, if you choose to subscribe;
• technical information needed to operate and secure the website; and
• your cookie and privacy choices.

You do not have to provide personal information simply to browse the website. If you submit an enquiry, I need your email address and message so that I can respond.

How I use your information

I use personal information to:

• respond to enquiries about artwork, prints, commissions, collaborations or other matters;
• manage correspondence and keep appropriate business records;
• send Early Access emails and studio updates where you have actively subscribed;
• operate, maintain and protect the website;
• record and respect cookie and privacy choices; and
• comply with legal obligations or establish, exercise or defend legal claims where necessary.

Lawful bases

I rely on the following lawful bases:

• Legitimate interests — to respond to enquiries, communicate with visitors, operate the website and manage my art practice.
• Steps before entering into a contract — where you ask about purchasing artwork, prints, commissions or another potential agreement.
• Consent — for Early Access and other optional marketing emails, and for any non-essential cookies or similar technologies. You can withdraw consent at any time.
• Legal obligation — where information must be retained or disclosed to comply with the law.

Early Access emails

If you subscribe to Early Access, I will use your name, if provided, and email address to send the updates described when you subscribe. You can unsubscribe at any time using the link in an email or by contacting me.

Withdrawing consent will not affect the lawfulness of anything done before consent was withdrawn.

Cookies and similar technologies

This website uses essential technologies required for the site to function and to remember visitors’ privacy choices. The Usercentrics consent banner allows you to accept, deny or change optional cookie choices.

The current website scan identifies Wix CMS as an essential component. If optional analytics, advertising or other services are added later, the consent information will be updated and those services will be controlled through the consent banner where required.

You can review or change your choices at any time using the fingerprint privacy icon at the bottom-left of the website.

Service providers and sharing

I do not sell personal information.

I use service providers that may process information on my behalf, including:

• Wix, which hosts the website and provides its forms, CMS and customer-management features;
• Google Workspace, which provides business email services; and
• Usercentrics, which provides the cookie consent system and records privacy choices.

I may also disclose information if required by law, or where reasonably necessary to establish, exercise or defend legal rights.

International processing

Some service providers may process information outside the United Kingdom. Where this happens, the provider must use an appropriate legal mechanism or safeguard for the transfer, such as an adequacy regulation or approved contractual protections.

How long I keep information

I retain information only for as long as it is reasonably needed for the purpose for which it was collected.

Enquiry and correspondence records are kept while I deal with the enquiry and afterwards where reasonably necessary for follow-up, business records or legal claims. Early Access subscription information is kept until you unsubscribe or ask for it to be deleted, subject to retaining a minimal record where needed to respect your request. Technical and consent records are retained according to the relevant service settings and applicable legal requirements.

I periodically review information and delete or anonymise it when it is no longer needed.

Your rights

Depending on the circumstances, you may have the right to:

• ask for a copy of your personal information;
• ask for inaccurate or incomplete information to be corrected;
• ask for your information to be deleted;
• ask for its use to be restricted;
• object to certain uses of your information;
• receive certain information in a portable format; and
• withdraw consent where processing is based on consent.

These rights are not absolute and may depend on the circumstances and lawful basis involved. To make a request, email michael@michaelmcgarryart.com.

Your right to object

You may object to processing based on legitimate interests. You also have the right to object at any time to the use of your personal information for direct marketing. If you object to direct marketing, I will stop using your information for that purpose.

Complaints

Please contact me first if you have a concern so that I can try to resolve it.

You also have the right to complain to the Information Commissioner’s Office, the UK data protection regulator:
